The ECJ Classifies Organisms That Have Been Developed With the Aid of New Mutagenesis Methods as Genetically Modified.

July 2018. The European Court of Justice (ECJ) ruled on 25.07.2018 in Case C-528/16 that organisms bred by using new mutagenesis methods are genetically modified organisms (GMOs) within the meaning of Article 2 (2) of Directive 2001/18 / EC (Deliberate Release Directive) and are not excluded from the scope of this Directive under Article 3 (1).

Mutagenesis refers to processes that allow the genome to be altered without the introduction of foreign genes. The new mutagenesis methods include, for example, CRISPR /Cas9, TALENs or ODM.

This means that plants that have been modified with the aid of these procedures are subject to the relevant GMO labeling and approval regulations in the EU.
