Infant formula and follow-on formula: new residue definitions

New EU regulations adjust residue definitions with Reg (EG) 396/2005

Dec 2021. With the publication of the Delegated Commission Regulations (EU) 2021/1041[1] and (EU) 2021/1040[2], new residue definitions came into force for infant formula and follow-on formula. In this context, the residue definitions have been harmonised with those of the general Regulation on maximum residue levels of pesticides in or on food and feed (Regulation (EC) 396/2005[3]).

What changes in particular?

Until now, European food law has provided different residue definitions for pesticide residues in general and specifically for baby food. This sometimes led to additional work in the interpretation practice. Therefore, the residue definition for infant formula has now been aligned with the broader definition from Regulation (EC) 396/2005. 

Important changes in the evaluation of residues mainly relate to the sum regulations for the following substances:

  • Fipronil
  • Propylene thiourea („PTU“)
  • Fensulfothion
  • Terbufos

Scope of the new regulations

The changes, effective since 15 July 2021 without transitional period, affect only infant formula and follow-on formula, as well as foods for special medical purposes developed to satisfy the nutritional requirements of infants and young children. Complementary foods (e.g. processed cereal-based foods) are not affected by the new regulations.
